Ajman Centre for Trade conciliation and Arbitration

Ajman Centre for Trade conciliation and Arbitration has been established on 30-10-2004 by virtue of the Amiree Decree No.(6) for the year 2004 been issued by H.H. Sheikh Humaid Bin Rashid Al Naeemi , Member of the Supreme Council the Ruler of Ajman. The centre is located in the premises of Ajman Chamber of Commerce and Industry and administratively it follows the Chamber and specialized in settling disputes forwarded as per the mentioned law through arbitration or conciliation . The centre is managed by the committee of the centre chaired by one the board members in additionto four other members from experts in the field of trade arbitration including the legal advisor of the chamber who is the secretary of the centre .

Objectives of the center :

• To stele disputes in a totally neutral manner.
• To keep neutral always while solving disputes .
• To ensure the right of presenting his case to every opponent .
• To take final settlement dually and according to UAE constitution and laws .

 

Area of specialization :

• To determine the managerial and financial affairs related to the center.
• To supervise executing the arbitration and conciliation system and rules.
• to establish any internal procedures and regulations to systemize the management of the center.
• To prepare the annual report about the activities of the center and forward the same for board approval.
• to keep a list including all the specialized arbitrators .
• select one or more arbitrators or an arbitration committee for any disputes .
• Endeavor to establish a fair system of arbitration.
• to summarize the evidences on the basis of which the arbitration has taken place.
• to decide on the place for arbitration if not agreed between opponents .
• to suggest a reasonable arbitration fees and salaries for arbitrators .
• to keep records of all the center and the arbitration documents .

Arbitration Procedures

Applicant for arbitration shall submit a written request for arbitration addressed to the secretary of the committee and the following shall be included in his application :

Name ,occupation , nationality and the address of the Plaintiff .

Name , nationality and the address of the Defendant .

Subject of the dispute , claims of the Plaintiff and his evidences .

Arbitration agreement as mentioned in Article 9 of this decree .

Name and address of the arbitrator selected by the applicant otherwise a written authorization letter to the administration of the centre to assign such arbitrator or all of them.

The application and attachments shall be prepared in copies equal to the number of arbitrators stated in the agreement .

Application for arbitration shall not be accepted unless the registration fees are fully paid .

 

Registration fees :

The centre shall charge AED Five Hundred for each dispute non refundable to be paid on submitting the application for arbitration or conciliation
